Antitrust Class-Action: $40 Million in Settlement Payments

We played a key role in recovering $40 million for various classes of plaintiffs in a multidistrict class-action for antitrust violations. In 2016, our firm was the first to develop and plead antitrust claims in federal court against 1-800 Contacts, which was the leading online retailer of contact lenses in the United States. According to these claims, 1-800 Contacts used sham litigation and collusive settlement agreements with rival sellers to limit online advertising, limit competition on prices, and withhold key information from customers. Shortly thereafter, several other law firms brought closely similar cases. All of these cases were subsequently consolidated into a multidistrict class-action, which was extensively litigated and eventually settled in a federal district court in Utah. In all, the plaintiffs recovered $40 million under publicly disclosed settlement agreements. In this matter, we collaborated with several other leading antitrust firms. Original Case: Stillings v. 1-800 Contacts (N.D. Cal., 2016, 3:16-cv-5400); Consolidated Cases: Thompson v. 1-800 Contacts, Inc. (D. Utah, 2016, 2:16-cv-01257-TS).
