On behalf of a publicly-traded hardware retailer, we filed antitrust claims against the country’s largest retailer of hardware, which in response moved to dismiss the claims. A federal district court denied its motion, finding that our client’s claims were well pled and resolving key points of law in our client’s favor. We thereafter settled the case under a confidential settlement agreement. Our client’s antitrust challenge was that the dominant retailer had wrongly restrained trade by using exclusive-dealing agreements with major suppliers of specialized tools.
